Terms of Service
These terms are written in plain language on purpose. They cover what BingeWise is, what you can expect from us, and what we expect from you. By creating an account or using BingeWise you agree to them.
1. What BingeWise is
BingeWise (bingewise.tv) is a TV show tracker and recommender: you track what you watch, and we combine your taste signals with show data and AI models to recommend what to watch next. "We", "us", and "BingeWise" mean the operator of bingewise.tv. Contact: [email protected].
2. Your account
- You must be at least 13 years old to use BingeWise.
- Give us a real email address you control — it is how you sign in and how we reach you about your account.
- Keep your password to yourself. You are responsible for activity on your account.
- You can delete your account at any time in Settings → Account. Deletion is permanent and immediate — see the Privacy Policy for exactly what is removed.
3. Pricing and billing
- Plans. BingeWise offers a free tier plus paid plans ("Plus" and "Duo" — Duo covers two linked accounts), billed monthly or annually. Prices are shown on the pricing page and at checkout before you pay anything.
- Founding Member rate. The Founding Member annual plan is a price-locked Plus subscription: your rate stays locked for as long as that subscription remains active.
- Renewal. Subscriptions renew automatically at the end of each billing period until you cancel.
- Cancellation. Cancel any time, yourself, through the billing portal linked from Settings → Account. No emails, no phone calls, no retention flows. Cancellation takes effect at the end of the period you already paid for, and you keep access until then.
- Refunds. The final refund policy will be published here on the day paid plans launch. What we intend to offer: a full refund within 14 days of being charged on an annual plan (your first purchase of that plan, no questions asked — email [email protected]); monthly plans not refunded, cancel any time to stop the next charge. Whatever the final terms say: if we ever charge you in error, we will refund it promptly regardless of plan.
- Duo seats. A Duo subscription sponsors a second linked account. The seat lives and dies with the sponsoring subscription: if the sponsor cancels or the subscription lapses, the linked seat ends with it. If the linked member has their own paid subscription, their own subscription takes precedence over the seat.
- Failed payments. If a renewal charge fails, you keep access while our payment processor retries. Only if recovery fails does the account move to the free tier — nothing is deleted.
- Price changes. If a price changes, we will tell you in advance (in-app or by email) and update these terms' effective date. A change applies from your next renewal, never mid-period. Founding Member rate locks are honored.
- Early users. Accounts created before paid plans launched receive a free period of Plus and a Founding Member offer. The specifics (dates and duration) are announced in-app and by email at launch.
- Payments are processed by Stripe. Your card details go directly to Stripe; we never see or store card numbers. Stripe's own terms and privacy policy apply to the payment itself.
4. Fair use
Don't abuse the service. Specifically, don't:
- access other people's accounts or data, or probe for ways to;
- scrape, bulk-export, or resell data from BingeWise (your own data has a one-click export in Settings — use that);
- circumvent rate limits, usage meters, or plan gates;
- use BingeWise to send spam or abusive content to other users.
Community standards
The same goes for anything you write or share — reviews, notes, profile text, and messages. The following have no place on BingeWise:
- Harassment or targeted abuse — attacking, threatening, or piling onto another person;
- Hate speech — attacking people for who they are;
- Sexual content — BingeWise is for talking about TV, not for sexual material;
- Graphic violence — gratuitously violent or gory material;
- Spam or scams — unsolicited promotion, phishing, or deceptive schemes;
- Impersonation — pretending to be another person or organization.
Any sexual content involving minors is zero-tolerance: we remove it, close the account immediately, and report it to the relevant authorities.
We may remove content that crosses these lines and may suspend or close accounts that do these things. Where practical we will warn you first.
If another user is bothering you, you can block them (from their profile; manage your block list in Settings → Sharing) and report them or their messages to us in-app. Reports are reviewed by a human — there is no automated moderation and no guaranteed turnaround. Blocking takes effect immediately and does not notify the other person.
5. Your content
Ratings, reviews, notes, and taste tags you write remain yours. You give us permission to store and process them to run the service — including showing them to friends you have connected with, according to your sharing settings, and processing free text with AI providers as described in the Privacy Policy. Delete your account and this permission ends with it.
6. AI features
Recommendations, match scores, taste profiles ("Show DNA"), recaps, and similar features are generated with the help of AI models. They are predictions, not promises: they can be wrong, incomplete, or oddly confident. Where a recommendation gives a reason, the reason reflects real signals from your data — we do not fabricate justifications.
7. Third-party data
Show metadata, images, schedules, ratings, and availability come from third-party sources, credited here and in the app (Settings → Data & privacy):
- TMDB — show details, images, and more. This product uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB.
- JustWatch — supplemental streaming availability data, provided via TMDB.
- TVmaze — schedule, episode, and availability data, licensed CC BY-SA (tvmaze.com).
- OMDb — IMDb/Rotten Tomatoes rating figures, licensed CC BY-NC (omdbapi.com).
- Wikidata — creator and franchise relationships (CC0).
- Streaming Availability API by Movie of the Night — deep links and leaving-soon dates (movieofthenight.com).
This data can be wrong or stale — always confirm availability with the streaming service before subscribing to anything on our say-so.
8. The service is provided as-is
We work hard to keep BingeWise fast, correct, and available, but it is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, our total liability for any claim related to the service is limited to the amount you paid us in the twelve months before the claim (or, if you have paid nothing, to zero). Nothing in these terms limits liability that cannot lawfully be limited.
9. Ending things
You can stop using BingeWise and delete your account at any time. We can suspend or terminate accounts that violate these terms, and we may discontinue the service itself — if that ever happens, we will give as much notice as we reasonably can so you can export your data.
10. Changes to these terms
When these terms change, the version number and effective date at the top change with them. For material changes — anything about money, your data, or your rights — we will notify you in-app or by email before the change takes effect.
